1. Controller

The controller of personal data processed through Formak is [DAIARK S.L.]. For payment data, Paddle (Paddle.com Market Ltd) acts as an independent controller; its handling of card and billing data is governed by Paddle's own privacy policy. We do not receive or store your full card details.

2. What we process, and why

Account data (email, authentication identifiers, password hash held by our authentication provider). Purpose: to create and operate your account. Legal basis: performance of the contract (Art. 6(1)(b) GDPR).

Uploaded footage and derived data. Your uploaded video/images contain images of identifiable people and are personal data. From them we derive biomechanical data (3D skeleton, joint angles, metrics). Purpose: to provide the analysis you request. Legal basis: performance of the contract (Art. 6(1)(b)).

Usage and security data (analysis events, credit usage, IP address, device/browser data, anti-abuse signals). Purpose: to operate, secure, meter, and prevent abuse of the service. Legal basis: legitimate interests (Art. 6(1)(f)) in running a secure, functioning service.

Support data (your correspondence with us). Purpose: to respond to you. Legal basis: legitimate interests / performance of the contract.

Model-improvement data — only if you opt in. We do not use your uploaded footage to train or improve our models by default. You may opt in, per clip or in your settings ("Help improve Formak"). Legal basis: your consent (Art. 6(1)(a)), which you can withdraw at any time. When you opt in, you confirm that everyone shown is a consenting adult, or that you hold parental/guardian consent for any minor shown. Withdrawing consent stops further use; data already incorporated into a trained model may not be fully removable, which we explain at the point of opt-in. We do not knowingly use footage involving minors for training.

3. Processors and recipients

We use the following service providers, under data-processing terms:

  • Supabase — authentication and database (European Union).
  • Cloudflare — hosting, content delivery, security, and connectivity.
  • Resend — transactional email (Ireland / EU).
  • Paddle — payment processing (as an independent controller).

4. International transfers

Some providers (e.g., Cloudflare, Paddle) may process data outside the EEA. Where they do, transfers are protected by appropriate safeguards, such as the European Commission's Standard Contractual Clauses or an adequacy decision. [Confirm per provider.]

5. Retention

  • Account data: while your account is active, then deleted or anonymised within 30 days of closure.
  • Uploaded footage: [e.g., deleted within __ days of processing / retained only while needed to deliver and let you review your results].
  • Derived biomechanical data: while your account is active, unless you delete it sooner.
  • Usage / security logs: 90 days.
  • Billing records: retained as required by tax and accounting law (handled largely by Paddle).

6. Your rights

You may request access, rectification, erasure, restriction, portability, and objection, and may withdraw consent at any time, by emailing [email protected]. You also have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD, www.aepd.es) or your local supervisory authority.

7. Security

We apply technical and organisational measures appropriate to the risk, including encryption in transit, access controls, and database-level isolation between accounts. No system is perfectly secure and we cannot guarantee absolute security.

8. Children

The service is intended for adults. We do not knowingly process the personal data of children as account holders. If you believe a minor has provided us data without appropriate consent, contact [email protected].

9. Changes

We may update this policy and will post the updated version with a new effective date; we will notify you of material changes.
